Terms of Service for Axess Hive

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Axess-Corrosion, Inc. ("Axess-Corrosion," "Company," "we," "us," or "our") governing your access to and use of the Axess Hive mobile application ("App" or "Service").

By downloading, installing, or using Axess Hive, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you individually and the organization.

15.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at janus@axess.energy to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days.

Any dispute not resolved informally shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA). Arbitration will be conducted in Harris County, Texas.

15.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any legal action must be brought in the courts located in Harris County, Texas.

You may not assign your rights under these Terms. We may assign our rights without restriction.

We are not liable for delays or failures due to circumstances beyond our reasonable control.
